Terms of Service
These Terms govern your use of the Rapport website and, where applicable, pilots or paid access to the Rapport product. A signed order form or pilot agreement may add or modify commercial terms. Have counsel review before production use if required.
1. Agreement
By accessing getrapport.ai or using Rapport services, you agree to these Terms. If you use Rapport on behalf of a dealership or group, you represent that you have authority to bind that organization, and “you” includes that organization.
2. What Rapport provides
Rapport offers conversational intelligence for automotive fixed operations, including tools that can capture consented write-up conversations, identify deferred work, and draft follow-ups for service advisors. Features may change as we improve the product. Marketing pages describe intended capabilities; your order form or pilot scope controls what is enabled for your store.
3. Website and walkthrough requests
The public website is informational. Submitting a walkthrough request does not create a paid contract. We may contact you using the information you provide. You agree not to misuse the site (including scraping that harms service, attempting unauthorized access, or submitting unlawful content).
4. Pilots and accounts
If you start a pilot or paid subscription:
- You will keep account credentials confidential and limit access to authorized personnel
- You are responsible for activity under your accounts and for configuring roles appropriately
- Pilot duration, fees (if any after the pilot), and support levels are as stated in the applicable order or pilot confirmation
5. Your responsibilities and compliance
You are responsible for:
- Obtaining all notices and consents required to record or process customer and employee conversations
- Using Rapport only for lawful business purposes related to your service operations
- Reviewing outbound messages before they reach customers when you use manual mode, and configuring auto mode consistent with your policies
- Ensuring DMS/CRM integrations and data you upload are accurate and properly authorized
6. Customer content
You retain ownership of your dealership data and conversation content (“Customer Content”). You grant Rapport a limited license to host, process, and display Customer Content solely to provide and improve the services for you, including generating summaries and drafts. Insights may be used in aggregate, de-identified form to improve the product. We do not claim ownership of your RO data or customer conversations.
7. Intellectual property
Rapport, including software, models (as provided to you), branding, and site content, is owned by Rapport or its licensors. These Terms do not transfer ownership. You may not copy, reverse engineer (except where prohibited by law), resell, or create competing products from our services except as expressly allowed in writing.
8. Acceptable use
You may not use Rapport to violate law, infringe rights, attempt to identify individuals beyond your legitimate business purpose, probe our systems without authorization, or interfere with other customers’ use of the service.
9. Third-party services
Integrations (DMS, CRM, messaging providers, analytics) are subject to those providers’ terms. Rapport is not responsible for third-party outages or data handling outside our control once data is transferred at your direction.
10. Disclaimers
THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAPPORT DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-GENERATED SUMMARIES AND DRAFTS MAY BE INCOMPLETE OR INCORRECT; YOU MUST REVIEW OUTPUTS BEFORE RELYING ON THEM FOR CUSTOMER COMMUNICATIONS OR OPERATIONAL DECISIONS.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAPPORT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICES IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES IN THAT PERIOD (OR ONE HUNDRED U.S. DOLLARS IF YOU ARE ON A FREE PILOT AND HAVE PAID NOTHING).
12. Indemnity
You will defend and indemnify Rapport against claims arising from your Customer Content, your failure to obtain required consents, your misuse of the services, or your violation of these Terms or applicable law.
13. Suspension and termination
We may suspend or terminate access for material breach, legal risk, non-payment (when fees apply), or misuse. You may stop using the website at any time. Pilot or subscription termination follows the applicable order. Upon termination we may delete or return Customer Content per that agreement and our Privacy Policy.
14. Privacy
Our Privacy Policy explains how we handle personal information. By using the site or services, you acknowledge that policy.
15. Governing law
These Terms are governed by the laws of the State of California, excluding conflict-of-law rules, unless a signed commercial agreement specifies otherwise. Courts in California will have exclusive jurisdiction for disputes arising from the public website, subject to any arbitration terms in a signed order.
16. Changes
We may update these Terms by posting a revised version on this page. Continued use of the website after changes become effective constitutes acceptance. Material changes to paid product terms will be communicated as required by your agreement.
